Central America and the Caribbean regional synthesis: climate change, displacement and the right to education Year of publication: 2023 Corporate author: UNESCO From rising sea level to drought and increasingly frequent natural disasters - the effects of climate change are well-known today. However, its effect on human mobility is just coming to the forefront of the political discussion. In 2020 alone, 30.7 million people globally were displaced by natural disasters. Central America and the Caribbean region is prone to the effects of climate change and displacement due to its socioeconomic characteristics and geographic location. Country case studies were carried out in the Bahamas, Cuba, the Dominican Republic, Guatemala, and Jamaica to examine the impacts on the right to education in the region. The research shows that climate change directly threatens education through the destruction of schools and property. It also leads people across borders where their legal residency and right to education are not guaranteed. This report aims to guide policy-makers on how to ensure education is protected in the face of climate change and displacement. The report is one of four being developed and will contribute to UNESCO’s global initiative on climate change, displacement and the right to education. It will inform the development of a Global Report with policy recommendations.

This first report highlights the need to place equity at the heart of efforts to improve access to and the quality of education, without which efforts to improve access to and the quality of education could inadvertently widen existing inequalities.
Guidelines to Strengthen the Right to Education in National Frameworks Year of publication: 2021 Corporate author: UNESCO These Guidelines aim to strengthen national frameworks by assisting countries and stakeholders in conducting an assessment of the compatibility of their national education legal and policy framework with international standard-setting instruments on the right to education, and in light of SDG 4 commitments. These Guidelines provide a hands-on approach aiming to assist in the review of national education legal and policy frameworks in view of:Developing practical knowledge on the right to education based on the Right to education handbook and supporting capacity developmentProviding operational tools to assess the status of the right to education at country level and its compatibility with international and regional human rights obligations and international commitments (notably SDG 4)Identifying legal and policy gaps in education at country level and resulting challengesMaking recommendations for the full alignment of national constitutions, legislation , singular and policies with international standards and provisionsProviding insights on how to implement the recommendations in view of necessary reforms.
Right to Pre-Primary Education: A Global Study Year of publication: 2021 Corporate author: UNESCO Early childhood care and education is increasingly recognized as an essential element in realizing a wide range of educational, social and economic rights. Children from vulnerable households and communities stand to gain most from access to quality early learning opportunities. With about 50 per cent of children globally not yet enrolled in pre-primary education, enabling their inclusion remains a central question for education policymakers, stakeholders and parents.This Study provides a global overview and an analysis of the adoption of legal provisions for free and compulsory pre-primary education at national level. By offering a rights-based perspective to the implementation of pre-primary education, it aims to complement existing literature on SDG Target 4.2, which focuses mainly on policy outcomes.The results show that pre-primary education is a well determined and defined right in too few countries. Yet, the benefit of free and compulsory education observed is that children appear to have higher rates of early childhood well-being.In light of the research conducted and its main conclusions, a set of levers to promote the inclusion of early childhood and pre-primary education as a human right within long-term education and development objectives are presented in terms of governance and financing, legal framework, societal expectations, monitoring and evaluation and early childhood development overall. Prioritizing the needs of young children and the fulfilment of their right to free and compulsory pre-primary education is a critical opportunity for governments to make positive differences in children’s lives and to achieve broader national, social and economic goals.

The report reflects on the 2030 Refugee Education Strategy (launched in 2019) and where notable progress has been made as well as areas where greater investment and enhanced collaboration are needed to meet the strategic objectives of the Strategy.
Learning at Risk: the Impact of Climate Displacement on the Right to Education; Global Report Year of publication: 2023 Corporate author: UNESCO How climate displacement the impacts the right to education The growing impacts of climate change and displacement on education can no longer be ignored. The increasing number of people displaced due to climate change faces unique vulnerabilities, especially in terms of access to education. This challenge is not only attributed to the often limited political and legal recognition of these displaced persons, but also stems from the global community’s lack of awareness of the diverse obstacles they encounter in seeking access to education. This global report, which concludes the “Initiative on the impact of climate change and displacement on the right to education”, aims to provide guidance to policy-makers worldwide on how to better respect, protect and fulfil the right to education of climate-displaced people. It provides an overview of climate-induced barriers to education, and global policy guidance on how to ensure the protection of the right to education of these populations. The report will inform UNESCO’s Initiative on “The evolving right to education within a lifelong learning perspective” which is investigating how the right to education, as enshrined in international normative instruments, could be strengthened to meet modern needs in our rapidly changing societies.

In Asia and the Pacific alone, 21.3 million people were displaced, making it the region the most impacted by national disasters and climate change in the world. Therefore, country case studies were carried out in Bangladesh, India, Indonesia, Tuvalu, and Viet Nam to examine not only specific vulnerabilities to climate change and related mobility, but also the impacts of climate change on the right to education in Asia and the Pacific. These case studies show that climate change directly threatens education – through the destruction of schools and property – but also indirectly puts education in peril by forcing people to cross borders, ensuring neither legal residency nor the right to education. This regional synthesis report aims to guide policy-makers through providing operational policy recommendations on how to ensure education is protected in Asia and the Pacific in the face of climate change and displacement from a human rights-based approach. Her Atlas: Interactive Advocacy Tool on Girls’ and Women’s Right to Education Year of publication: 2023 Corporate author: UNESCO Many girls and women cannot exercise their right to education due to gender inequality and discriminatory practices. Poverty, early marriage, and gender-based violence are just some of the many reasons behind the high percentage of global female illiteracy and school drop-outs. Strengthening the right of girls and women to quality education is key to eliminate discrimination and to achieve equal rights between genders. This cannot be achieved without solid national legal frameworks that are rightsbased, gender responsive and inclusive. This is where HerAtlas comes in. HerAtlas, is a first of its kind online tool that maps the right to education of girls and women. It aims to enhance public knowledge and monitor the status of national constitutions, legislation and regulations related to education rights for girls and women to encourage countries to take action, strengthen their laws and policies, and lead to long term change. Concrete changes are already apparent. In 2019, 4% of countries were explicitly restricting the right to education of married, pregnant, and parenting girls. This has dropped to 2% in 2022, benefiting millions of girls who can now legally attend school when they marry or become pregnant.
Protect Her Rights, Strengthen Your Laws: Her Atlas; Status Report on Girls’ and Women’s Right to Education Year of publication: 2022 Corporate author: UNESCO UNESCO’s Her Education, our future initiative, Her Atlas was launched in 2019 with the aim to enhance public knowledge and monitor the status of national constitutions, legislation and regulations related to girls’ and women’s education rights in order to encourage countries to take actions to improve their legal frameworks. Three years after its launch, the research phase has been completed: overall, the legal frameworks of 196 countries have been thoroughly analyzed to evaluate the level of protection of girls’ and women’s right to education around the world. In an interactive world map format, Her Atlas uses a color-coded scoring system to monitor 12 indicators of legal progress towards gender equality in the right to education. This report marks the completion of the first research phase and intends to highlight some key trends outlined by the research work, and to emphasize examples of legal provisions regarding some aspects of girls’ and women’s right to education guaranteed by States’ domestic laws.
